Photography Terms & Conditions

1. Copyright
All copyrights for the photographs remain the property of Xinyan Photography at all times, worldwide.

2. Client Usage
The client is purchasing prints or digital images for personal use only, and may not sell, reproduce, or authorize use by any third party without written permission from Xinyan Photography.

3. Display
The client grants Xinyan Photography permission to display selected images for promotional use in portfolios, advertising, brochures, websites, magazines, sample albums, and photo competitions.

4. Creative License, Coverage, and Reproduction
4.1 Photographs will be taken at the photographer’s discretion, with every reasonable effort made to accommodate the client’s wishes.
4.2 Special requests are welcomed but not guaranteed, due to variables like weather, lighting, location limitations, and subject cooperation.
4.3 Due to variations in lighting and digital sensor limitations, some colors may appear inconsistent across a set of images.
4.4 While all equipment is regularly checked and backup gear is used, Xinyan Photography is not liable for any loss of images due to unforeseen technical failures.
4.5 Retouching
Some selected images will be professionally retouched to enhance skin tone, brightness, contrast, and other elements, based on both the photographer’s and client’s preferences.
4.6 Final retouched JPEG images are usually delivered within 8 weeks of the raw file delivery. Printed products such as albums may require an additional 2 months for production after retouching is complete.

5. During the Photoshoot
5.1 Xinyan Photography will be the sole professional photographer at the scheduled session. Family members are encouraged to participate in the process.
5.2 The session begins at the agreed time and ends after the booked duration. The total time includes outfit changes, makeup touch-ups, and travel between locations. The photographer does not guarantee a specific number of photos.
5.3 Clients are responsible for covering any travel or transportation fees related to the photoshoot.

6. Style
Yanhong Zhang specializes in documentary-style and fashion-inspired portraiture. By booking, the client acknowledges familiarity with the photographer’s style, and agrees that each session is guided by creative vision. Final images may differ from past examples, reflecting the artistic evolution of the photographer.

7. Booking Deposit and Payment
A booking deposit is required to confirm your session. The deposit secures your date and will be credited toward your final order unless otherwise agreed.

8. Cancellation
8.1 Cancellations made more than 6 calendar days before the session are eligible for a full refund of the deposit.
8.2 If the photographer is unable to perform due to illness, natural disaster, or events beyond their control, the deposit will be refunded in full. However, Xinyan Photography is not liable for any further compensation, including image loss due to technical failure or postal issues.

9. Personal Accident
9.1 Clients are responsible for their own safety and agree to follow any reasonable instructions from the photographer to ensure a safe experience for all involved.
9.2 Any participation by clients, their guests, or children is at their own risk. Xinyan Photography is not liable for any personal injury during the shoot.

10. Modeling Agreement (if applicable)
By participating in a model session, you agree to the following:
10.1 Xinyan Photography may use your images in whole or in part for promotional, editorial, or artistic purposes.
10.2 The images may be used to represent an imaginary persona and may include accompanying text not attributed to your real identity.
10.3 You waive all claims of ownership and assign full copyright to Xinyan Photography.
10.4 No additional compensation will be provided.
10.5 The photographer may grant use of images to third parties, but ownership remains with Xinyan Photography.

11. Limitation of Liability
Except as covered under the Consumer Guarantees Act 1993, Xinyan Photography is not responsible for:

A. Delays in delivery of final products
B. Loss of profits or income
C. Indirect or consequential damages
D. Loss due to misinterpretation of verbal requests or errors in communication
